Mindfully Made Farm is powered by Shopify, which enables us to provide the online store and related services to you.

These Terms of Service, together with any policies referenced here, describe your rights and responsibilities when you use our website, purchase from us, attend a workshop, or otherwise interact with our services.

By using our services, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given consent for your minor dependents to use the services on devices you own, purchase, or manage.

To use the services, including browsing our online store or purchasing products, you may be asked to provide information such as your name, email address, billing information, payment information, shipping information, and other order details. You represent and warrant that all information you provide is accurate, current, and complete.

You are responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to another person.

Section 2: Our Products

We make every reasonable effort to describe and display our products accurately. However, product colors, appearance, texture, and packaging may differ from how they appear on your screen due to device settings, photography, lighting, and handmade variation.

Our products are made by hand in small batches. Natural variation in color, scent, texture, shape, size, weight, and appearance is expected. These differences are part of handmade work and are not considered defects.

Product descriptions, prices, availability, ingredients, packaging, and other product details may change at any time without notice. We reserve the right to discontinue any product at any time and may limit quantities of any products offered to any person, geographic region, or jurisdiction.

Section 3: Ingredient and Use Information

Product and ingredient information is provided for general education and transparency. Mindfully Made Farm products are not intended to diagnose, treat, cure, or prevent any disease. Please review all ingredients before use.

Our products may contain animal-derived ingredients, milk-derived ingredients, beeswax, essential oils, botanicals, natural oils, butters, waxes, and other ingredients that may not agree with every person’s skin, hair, body, household, or circumstances.

Do not use any product if you are allergic or sensitive to a listed ingredient. Discontinue use if irritation occurs. Natural ingredients can still cause irritation, sensitivity, or allergic reactions in some people.

Unless a product is specifically sold as food, it is not intended to be eaten or ingested.

You are responsible for determining whether a product is appropriate for your own use, your household, your family, or anyone else who may use the product. For babies, young children, pregnancy, nursing, allergies, known sensitivities, medical concerns, or other special circumstances, use your own judgment and consult a qualified professional when needed.

Section 4: Orders

When you place an order, you are making an offer to purchase. Mindfully Made Farm reserves the right to accept, decline, cancel, or limit any order for any reason at our discretion.

Your order is not accepted until Mindfully Made Farm confirms acceptance. We must receive and process payment before your order is accepted.

Please review your order carefully before submitting it. We may be unable to accommodate cancellation requests after an order is accepted, packed, shipped, prepared for pickup, or otherwise in process.

If we do not accept, make a change to, or cancel an order, we will attempt to notify you using the email, billing address, shipping address, or phone number provided at the time the order was placed.

We reserve the right to refuse, cancel, or limit any order, including orders that appear fraudulent, abusive, made for resale, made in violation of applicable law, or otherwise inconsistent with our business practices.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export unless we have agreed otherwise in writing.

Section 5: Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation.

Unless otherwise stated, posted prices do not include taxes, shipping, handling, customs, import charges, or other fees that may apply.

Prices posted online may differ from prices offered at farmers markets, the farm store, events, workshops, or other sales channels.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases. You agree to promptly update account and payment information so we can complete transactions and contact you as needed.

You represent and warrant that any payment information you provide is true, correct, complete, and authorized for use by you, and that you will pay all charges incurred at the posted prices, including shipping, handling, and applicable taxes.

Section 6: Shipping and Delivery

Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, customs processing, holidays, incorrect addresses, events outside our control, or other delays after an order leaves our hands.

Once we transfer products to the shipping carrier, title and risk of loss pass to you to the fullest extent allowed by law.

If a package is marked delivered by the carrier but you cannot locate it, please contact the carrier first. We will help where we reasonably can, but we are not responsible for lost or stolen packages after confirmed delivery.

Section 7: Local Pickup, Heat-Sensitive Products, and Perishable Goods

Local pickup may be offered at Mindfully Made Farm, local markets, or other locations when available. Pickup times and locations must be confirmed before arrival. We are a working farm, and pickup availability may depend on farm schedule, weather, market days, animals, and product availability.

Some products, including balms, lotions, deodorants, and candles, may soften or melt in warm weather. We pack orders with care, but we cannot control temperature exposure once an order leaves our hands or is transferred to a carrier. Please bring packages inside promptly after delivery.

Farm goods, food items, eggs, meats, and other perishables may be final sale unless there is a clear issue with the order. Availability may change based on season, inventory, animals, weather, and applicable laws.

Customers are responsible for inspecting perishable goods at pickup or delivery and storing them properly after receipt. Once perishable goods are picked up, delivered, or transferred to the customer, we are not responsible for improper storage, handling, or use.

Section 8: Workshops and Farm Activities

Mindfully Made Farm may offer workshops, classes, farm activities, demonstrations, or other in-person experiences. Workshop details, dates, times, prices, age guidance, cancellation terms, and participation requirements will be listed on the applicable workshop page.

Workshops may involve hands-on work, food, animals, raw ingredients, heat, sharp tools, basic protective gear, outdoor conditions, uneven ground, physical activity, or other normal conditions of a working farm.

By purchasing or attending a workshop, you acknowledge that you understand the nature of the workshop and agree to follow all instructions, safety directions, and common-sense rules provided by Mindfully Made Farm.

Not every workshop is suitable for every age, comfort level, or ability. If you have questions, please reach out and we will help you decide if a workshop is the right fit.

We reserve the right to refuse participation, remove a participant, or end participation without refund if a participant acts unsafely, ignores instructions, disrupts the class, mistreats animals, damages property, or creates risk for themselves or others.

Workshop cancellations, credits, and refunds are governed by our Refund Policy and any terms listed on the specific workshop page.

Section 9: Intellectual Property

Our website and services, including but not limited to trademarks, brands, text, displays, images, graphics, product reviews, video, audio, product names, designs, slogans, and the design, selection, and arrangement of such materials, are owned by Mindfully Made Farm, its affiliates, licensors, or service providers and are protected by applicable intellectual property laws.

These Terms permit you to use the website and services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from the website or services without our prior written consent.

Mindfully Made Farm’s name, logo, product names, service names, designs, and slogans are trademarks or trade dress of Mindfully Made Farm or its affiliates or licensors. You may not use them without our prior written permission.

Shopify’s name, logo, product names, service names, designs, and slogans are trademarks of Shopify. All other names, logos, product names, service names, designs, and slogans appearing on the website are the property of their respective owners.

We may provide access to tools offered by third parties as part of the services. We do not monitor, control, or have input over those tools.

You acknowledge and agree that third-party tools are provided “as is” and “as available” without warranties, representations, or conditions of any kind and without endorsement. We are not liable for your use of optional third-party tools.

Mindfully Made Farm is powered by Shopify, which enables us to provide the online store and related services to you. However, any sales and purchases you make through our store are made directly with Mindfully Made Farm.

By using the services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Mindfully Made Farm, including any injury, damage, or loss resulting from purchased products, services, workshops, or transactions.

You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Mindfully Made Farm.

We do not guarantee, represent, or warrant that your use of the services will be uninterrupted, timely, secure, or error-free.

This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, personal reactions, allergic reactions, product misuse, workshop participation, farm activity participation, shipping delays, lost packages, heat exposure, or similar damages, whether based in contract, tort, negligence, strict liability, or otherwise, arising from your use of the services, purchase or use of products, attendance at workshops, participation in farm activities, or any other claim related to the services or products.

Nothing in these Terms is intended to limit liability that cannot legally be limited.

You agree to indemnify, defend, and hold harmless Mindfully Made Farm, Shopify, and our affiliates, partners, owners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, claims, or expenses, including reasonable attorneys’ fees, payable to any third party due to or arising out of:

1. your breach of these Terms or any policies incorporated by reference;
2. your violation of any law or the rights of a third party;
3. your access to or use of the services;
4. your misuse of any product;
5. your participation in any workshop or farm activity;
6. your failure to follow instructions, warnings, ingredient notes, product directions, workshop rules, or common-sense safety directions.

We will notify you of any indemnifiable claim, provided that failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent, not to be unreasonably withheld. You will cooperate in the defense of indemnified claims, including by providing relevant documents.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall still be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms.

These Terms and any disputes arising from or relating to the services, products, workshops, farm activities, purchases, or interactions with Mindfully Made Farm shall be governed by the laws of the State of New Hampshire, without regard to conflict of law principles.

You agree that any legal action shall be brought in the state or federal courts located in New Hampshire, and you consent to personal jurisdiction and venue in those courts.
